Order (on production of privilege logs)(5/8/97)

STATE OF MINNESOTA

COUNTY OF RAMSEY

DISTRICT COURT

SECOND JUDICIAL DISTRICT

The State of Minnesota By Hubert H. Humphrey, III, Its Attorney General, and Blue Cross and Blue Shield of Minnesota,

Plaintiffs,

v.

Philip Morris Incorporated, R.J. Reynolds Tobacco Company, Brown and Williamson Tobacco Corporation, B.A.T. Industries, p.l.c., British-American Tobacco Company Limited, BAT (U.K. & Export) Limited, Lorillard Tobacco Company, The American Tobacco Company, Liggett Group, Inc., The Council For Tobacco Research - U.S.A., Inc., and The Tobacco Institute, Inc.,

Defendants

ORDER

The above matter came on for hearing on May 6, 1997, before the Honorable Kenneth J. Fitzpatrick. Counsel represented to this Court that some, if not all, of the parties have failed to complete and produce their privilege logs as set forth in the Orders of this Court. The deadline for document discovery is more than four months past. The Court finds it disturbing that some if not all of the parties have failed to complete and produce their privilege logs, especially in light of the fact that depositions have begun and the trial date is less than nine months away.

BE ON NOTICE, therefore, that all parties are ordered to complete and produce their remaining privilege logs within thirty (30) days of this Order. All claims of privilege shall be deemed waived with respect to any documents not listed on such logs by this date.

SO ORDERED,

Kenneth J. Fitzpatrick

Judge of District Court

May 8, 1997
